Section 01

Who we are

TrustSmart AI is a product of SmartLife AU, operated by SmartLife AU, an Australian sole trader business with ABN 26 103 403 893 and ASIC-registered business name. We are based in Australia and registered for GST.

This Privacy Policy explains how SmartLife AU collects, uses, stores, and protects personal information in connection with your use of TrustSmart AI (available at trustsmartai.com.au).

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act.


Section 02

What information we collect

We collect only the minimum information necessary to operate TrustSmart AI. Depending on how you use the service, this may include:

Guest users (not signed in) may use up to 3 free checks per day without providing any personal information.


Section 03

Account information (Clerk)

TrustSmart AI uses Clerk for user authentication. Creating an account is optional for guest users but required to access more than 3 free checks per day or to subscribe to Pro.

When you create an account or sign in, Clerk collects and stores:

Clerk is a US-based authentication service. Your account data is stored on Clerk's servers in accordance with their privacy policy, available at clerk.com/legal/privacy. Clerk is compliant with SOC 2 Type II standards.

SmartLife AU receives your name and email address from Clerk when you are signed in, solely for the purpose of displaying your name in the app and associating your account with your Pro subscription.


Section 04

Payment information (Stripe)

TrustSmart AI uses Stripe to process Pro subscription payments. SmartLife AU does not collect, store, or have access to your credit card or banking details at any time.

When you subscribe to TrustSmart AI Pro, Stripe collects and stores:

Stripe is a US-based payment processor. Your payment data is handled in accordance with Stripe's privacy policy at stripe.com/au/privacy. Stripe is PCI DSS Level 1 certified.

SmartLife AU receives confirmation of successful payment from Stripe via webhook, which is used solely to activate your Pro subscription. We also receive your billing email to issue GST tax invoices.

GST tax invoices are issued automatically by Stripe on behalf of SmartLife AU for each billing cycle. These are sent to your billing email address and are available in your Stripe customer portal.


Section 05

How your submitted content is handled

Important: Content you submit (text, URLs, images, screenshots) is transmitted to Anthropic's API for AI analysis. It is not stored by SmartLife AU on any server or database after your check is complete.

When you submit content for a genuineness check:

Be mindful that content you submit may contain personal information about yourself or others. You should only submit content you have the right to share, and avoid submitting sensitive personal information unnecessarily.


Section 06

Image and screenshot handling

Images and screenshots are processed in memory only. They are not saved, logged, stored, or used for any purpose beyond the immediate analysis request you initiate.

When you upload an image or screenshot:

Screenshots may contain personal information about third parties. You are responsible for ensuring you have appropriate authority to submit any content you upload.

How we use your information

We use the information we collect only for the following purposes:

We do not use your submitted content to train AI models. We do not sell, rent, or share your personal information with any third party for marketing purposes.


Section 09

How we store and protect your data

Submitted content (text, URLs, images, screenshots) is not stored by SmartLife AU. It is processed transiently and discarded after each check.

Account data is stored by Clerk on their secure infrastructure. Payment data is stored by Stripe on their PCI DSS certified infrastructure. SmartLife AU does not maintain a separate database of user personal information.

Per-check usage metadata (account ID, input mode, token counts, and timestamp) is written to Netlify's serverless function logs for operational monitoring purposes. These logs are transient and are automatically deleted by Netlify within 24 hours on the current plan. This metadata does not include the content you submitted.

Our infrastructure uses HTTPS encryption for all data in transit. Our serverless functions run in Netlify's secure environment and your Anthropic API key is never exposed to the browser.

Any emails you send to us are stored in our business email system and retained only as long as necessary to resolve your enquiry.


Section 10

Cookies and analytics

TrustSmart AI uses Google Analytics 4 (GA4) to collect anonymised usage data. GA4 may set cookies in your browser to distinguish unique sessions.

Clerk also sets authentication cookies and tokens in your browser to maintain your signed-in session. These are essential for the app to function correctly when you are signed in.

We do not use advertising cookies, tracking pixels, or any third-party marketing trackers.

You can disable Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.


Section 11

Cross-border data transfers

Some of our third-party service providers are based in the United States. By using TrustSmart AI, you acknowledge that your information may be transferred to and processed in the United States or other countries outside Australia.

These transfers occur with the following providers:

We take reasonable steps to ensure these providers maintain appropriate data protection standards. Where applicable, these providers are bound by standard contractual clauses or equivalent protections.


Section 12

Sharing your information

We do not sell your personal information. We share information only in the following limited circumstances:

No other sharing occurs. We do not share your data with advertisers, data brokers, or any other commercial third parties.


Section 13

Your rights under Australian Privacy Law

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to:

To request account deletion, you may delete your account directly through the Clerk account portal, or contact us at hello@smartlifeau.com.au and we will action your request within 30 days.

To cancel your Pro subscription and request deletion of payment records, contact us at hello@smartlifeau.com.au. Note that we are required to retain GST tax invoice records for a minimum of 5 years under Australian tax law.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

AI disclaimer

Important: TrustSmart AI results are generated by an AI model and are provided for informational purposes only. They do not constitute professional fact-checking, legal advice, journalistic verification, or any other form of certified analysis.

Genuineness scores, verdicts, and source references produced by TrustSmart AI are AI-generated assessments and may be incomplete, inaccurate, or out of date. Always verify critical information through authoritative sources.

SmartLife AU accepts no liability for decisions made in reliance on TrustSmart AI analysis results.


Section 15

Children's privacy

TrustSmart AI is not directed at children under the age of 15. We do not knowingly collect personal information from children. If you believe a child has submitted personal information through TrustSmart AI, please contact us at hello@smartlifeau.com.au and we will take appropriate steps.


Section 16

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of TrustSmart AI after any changes constitutes your acceptance of the updated policy.

For significant changes, we will make reasonable efforts to notify users where possible.
